General terms and conditions

Ownership of rights

All rights, including copyright, in this website are owned by or licensed to Alan's of Eltham. You may not modify, distribute or re-post anything on this website for any purpose. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use is prohibited without the permission of Alan's of Eltham.

Accuracy of content

Alan's of Eltham has taken every care in the preparation of the content of this website, in particular to ensure that prices quoted are correct at time of publishing and all products have been fairly described. However, orders will only be accepted if there are no material errors in the description of the goods or their prices as advertised on this website. All prices are displayed inclusive of VAT. The weights, dimensions and capacities given are approximate only. We have made every effort to display as accurately as possible the colours of our products that appear on the website. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor's display of any colour will accurately reflect the colour of the product on delivery. To the extent permitted by applicable law, Alan's of Eltham disclaims all warranties, express or implied, as to the accuracy of the information contained in any of the materials on this website. Alan's of Eltham shall not be liable to any person for any loss or damage which may arise from the use of any of the information contained in any of the materials on this website.

Damage to your computer

Alan's of Eltham makes every effort to ensure that this website is free from viruses or defects. However, we cannot guarantee that your use of this website or any websites accessible through it won't cause damage to your computer. It is your responsibility to ensure that the right equipment is available to use the website and screen out anything that may damage it. Alan's of Eltham shall not be liable to any person for any loss or damage which may arise to computer equipment as a result of using this website.

Availability

All items are subject to availability. We will inform you as soon as possible if the goods you have ordered are not available by emailing you.

Delivery charges

Delivery charges vary depending on the delivery address. For full details of our delivery charges please refer to the delivery section. In the UK, delivery charge refunds can only be made in accordance with your legal rights under the Distance Selling Regulations and other legislation.

Collecting orders from the store

Items can be collected from the store free of charge. You will need to give your name, home address and email address or telephone number. You will also need to bring the card used to purchase the goods and a passport or driving license. You will also need to bring a printout of your order summary as proof of purchase when you collect your order.

Delays

Occasionally, the manufacture of your furniture may be delayed. This can be for various reasons such as material shortages, import delays or higher than anticipated demand. We will, of course, make every effort to keep you informed.

Cancellation right

Under the Distance Selling Regulations, UK consumers have the legal right to cancel their order within seven working days of receipt of the goods.

Law, jurisdiction and language

This website, any content contained herein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with English Law. The parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales. All contracts are concluded in English.

These terms and conditions do not affect your legal rights.

Payment

Purchases will be made in pounds Sterling. International credit card providers or banks will determine the exchange rate and may add an additional processing or administration charge in relation to such payment which international credit card holders will be liable to pay. All methods of payment, including credit cards are processed within one week of making the order online

Delivery

We will call you within one week of placing your order to give an approximate delivery date. Delivery dates will depend on which items are ordered. We will always endeavour to deliver items as quickly as possible. We will also make every effort to inform you if the dates change drastically.

Delays

Occasionally, the delivery of your furniture may be delayed or postponed. We will, or course, make every effort to keep you informed and discuss revised delivery timescales.

Delivery Arrangements

All orders are delivered by our home delivery service. Each vehicle has a trained crew of two people. When your order is ready, the home delivery service team will contact you to confirm your delivery date and either an am or pm timescale. Your delivery will not happen until you've been contacted by phone or by letter. If access to your delivery address is restricted, please let us know when speaking to the delivery team. On the delivery day the crew will contact you to inform you of any delays; please make sure we have the best number to use.
If you are unable to take immediate delivery, we can provide a storage service at a cost of £25 per full week.

Collecting orders from the store

Will it fit?

Please remember to make a note of your furniture's dimensions and check that it'll fit into your house and into your chosen room.

Bed and Furniture Disposal Service

We can arrange to dispose of your old beds and furniture but the product(s) will not be removed if infested, wet or heavily soiled. Products must be disassembled prior to collection. Please call to discuss prices as this depends on size and number of items.

On delivery

Before our delivery team arrive, please ensure that there is adequate access and space for your furniture to be delivered. Please inspect your items carefully and then sign for the furniture. If you're not satisfied for any reason, please inform the delivery team before signing. Please ensure that a responsible adult is available to receive and sign for the delivery. (If you elect a third party to accept the delivery on your behalf, you agree to us discussing all relevant data held on our system in relation to your order with them.)

After delivery

Your furniture is manufactured to the highest standards. We recommend that you look after it according to the care instructions. Once you have taken delivery of your furniture, we will only give refunds in accordance with your legal rights, for example, if the goods are not fit for purpose or as described. In the unlikely event that you have any issues with your furniture after delivery, we have a dedicated customer service team who can be contacted on 0208 850 1357

Cancellations & amendments

As soon as you realise that you need to change your order please contact our customer service team on 0208 850 1357 and one of our advisors will help you. You will be asked to confirm the change or cancellation in writing. If you amend or change your order, you may find there are changes to your delivery timescale and/or the price you pay for the item (as you'll be charged the current selling price on the day you amend or cancel the order). You have a legal right to cancel your order within 7 days of receiving your goods. All items returned must be unused, in a resalable condition and in their original packaging. If collection of an item is required, we will charge you the cost of collection (up to £100) of which you will be notified at time of cancellation.

Changes to legal notices

We reserve the right to change these terms & conditions from time to time and you should look through them as often as possible.

Exclusions of liability

Any disclaimers and exclusions of liability in these terms & conditions shall not apply to any damages arising from death or personal injury caused by the negligence of Alan's of Eltham or any of its employees or agents or fraud. These disclaimers and exclusions shall be governed by and construed in accordance with English Law. If any provisions of these disclaimers and exclusions shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

Privacy

We collect your email address, telephone number and address purely for the purpose of your order, we do not pass these on to any 3rd party nor will we contact
